1.Trust Deed: Trust Registration in India demands a Trust Deed. A trust deed includes the reason behind the trust and the powers of the trustees. It is basically a foundation that is signed by the trustees in the presence of at least two witnesses. The most basic document but the most important one.

A Trust Deed must furnish the following documents:

  • Motive: the motive of registering a trust;
  • Number of trustees present;
  • Vital information of all the trustees: Name, Father's Name, Contact Details, Permanent Address, Email Address, Designation, and Occupation;
  • Registered Office Address of the trust;
  • Rules and Regulations abided by the trust;
  • Trust's Proposed Name;
  • Identity proof of all the trustees as well as the settler;
  • Presence of at least two witnesses, settlor, and trustees at the time of Trust Registration in India.
  • Passport size-photograph of the settlor and trustees;

  • Self-attested transcripts of ID Proof of the settler: Adhaar Card, Driving License, Voter ID, or passport;

Trust Registration Procedure in India

Choose an appropriate name :

The trust registration procedure starts with the selection of an appropriate name. the name selected should not match with or resemble any other existing name. Thus, the name should not be restricted according to the provisions of the Emblems and Names Act, 1950.

Deciding the Trustees and Authors :

The very next step is to decide the number of trustees. The author can never be the trustee of trust thus, a minimum of two trustees are required for trust registration. There can be any number of maximum trustees. Also, the author of the trust shall be an Indian resident.

Formulation of Trust Deed and Memorandum of association :

Next, the most important step is to formulate the trust deed as well as the memorandum of association of the trust. The trust deed is the base of any trust that lays down the laws rules and regulations of the trust. Also, the deed decides the laws covering any change, removal, or addition of trustees to the trust.
Memorandum of association represents the relationship between the trust and its trustees. Besides this, it furnishes the objectives of a trust. Moreover, the MOA of trust defines the name, address, occupation, and other important details of the trustees.

Devising of Trust Deed on a stamp paper:

A trust shall devise the Trust Deed on a stamp paper which is to be of a certain percentage of the trust's total value as per the Indian Stamp Act, 1899.
After the submission of proper documents, the applicant can collect the certified copy of the trust deed within a period of one week.

Obtaining the Trust Registration Certificate:
