Duration for Trademark renewal

• In consonance with the rule 57 and 58 of the Trademark rules 2017, the trademark renewal shall be filed within 1 year before the date of expiry.
• In consonance with the rules 63 and 64 of the Trademark rules 2002, the trademark renewal can be applied within 6 months prior to the expiry date.
• Renewal can be filed within a period of 6 months after the date of expiration

India follows the following process to file Trademark Renewal:

Application Filing: To apply for trademark renewal the applicant or the authorized owner needs to make an application in Form TM-12. Trademark renewal shall be applied with the help of a professional to ensure the utmost accuracy and protection.

Trademark Application Status Check: After applying for trademark renewal, a status check is a must. One needs to check the trademark status until published by the Registrar.

Trademark Journal: If the Registrar of the Trademark finds the application worthy and acceptable, the trademark is advertised officially in the Official Gazette, the Trademark Journal. The advertisement of the trademark in the Trademark Journal confirms the successful renewal of the same. In the case of renewal, Trademark Opposition is not applicable as the trademark is already registered in India.
