What is GST?

GST or Goods and Services Tax is rewarded as a fruitful reform in India. Earlier where the tax was paid at several multiple tax stages is now just has to be paid all at once. Before, the tax was collected by the state in the form of VAT (Value Added Tax), where every state-owned its taxation law. The center was responsible for the taxation of inter-state goods and services. Several indirect taxes imposed by both state and center always resulted in overlapped taxation leading to high prices of goods and services. Goods and Services Law flourished in India like a major reform.

GST curbed the multiple taxation system reducing the unnecessarily inflated prices of goods and services. Moreover, The Goods and Services Act gathered the numerous indirect taxes under an umbrella abolishing the cascading effect of the previous tax system. Unlike the old indirect tax system, GST is comprised of three components:

CGST

As per the CGST Act, 2017, CGST is the tax levied by the central government on the intra-state sale of goods and services. (within the boundaries of a state)

SGST

Tax component collected by the state government on the intra-state sale of goods and services. (within the boundaries of the state)

IGST

IGST is the tax levied by the Central Government on the inter-state supplies of goods and services. (from one state to another state & in case of Export/ Import)

Do you need a GST Registration?

As per the GST jurisdiction, you must go for GST Registration if you or your business meets the following eligibility criteria.

1. Annual Aggregate Turnover

For Intra-State supply:
Intra-State supply means the supply of goods and services between the buyer and the seller when they are located in the same State.

For Exclusive supply of Goods Rs. 20 Lakhs or above Rs. 40 Lakhs or above
States Covered Arunachal Pradesh, Manipur, Meghalaya, Mizoram, Nagaland, Puducherry, Sikkim, Telangana, Tripura and Uttarakhand Rest of India
For supply of Services or mixed supply Rs. 10 Lakhs or above Rs. 20 Lakhs or above
States Covered Manipur, Mizoram, Nagaland and Tripura Rest of India

Note: Intra-state supply means supply of goods and services within the same state

2.For Inter-State supply:

Inter-State supply means the supply of goods and services between the buyer and the seller located in two different States.

Inter-State supply of Goods and Mixed supplies :

In the case of Inter-State supply of goods or mixed supplies, compulsory GST registration is required irrespective of the threshold limit.

3.E-Commerce business Owners

An individual selling goods or services through e-commerce platforms like Flipkart, UBER, OLA, Amazon, etc. are mandatory to apply for GST registration. The individual shall register for GST irrespective of the turnover. Thus, sellers on e-commerce platforms must obtain GST registration before entering into the online trade.
Here, E-commerce operators mean the business owners who:

1.Provide an online market/platform to the buyers and sellers.
2.The businesses using these online markets/platforms to sell their goods and services online.

Exception
Who is exempted from compulsory GST registration?

1. Businesses selling their products or services from the self-owned website. Hence, the comes under the general rule of threshold limit for GST registration.

4.Casual Taxable persons

Any individual demonstrating or putting a seasonal shop or stall to supply goods and services must apply to get GST registration irrespective of the annual aggregate turnover. Yet, a casual taxable person need not apply for GST registration if dealing in handicraft goods.

5.Voluntary registration

Any entity can obtain GST registration voluntarily for the benefits like enrolling in MSME registrations, Gem Portal registration, Government tenders. This also helps startups to scale up their business by creating its credibility before the governments and financial institutions like banks who count registered GST business owners for providing business loans or government schemes easily.

In consonance with GST law, carrying a business without registering for GST is considered an offense that can penalize you heavily.

Types of Registration

Regular Dealer scheme

Casual taxable person

Casual taxable persons if dealing in the handicraft trade are exempted from this scheme. Non-resident taxable person

A non-resident taxable person could be a foreigner supplying the taxable goods and services from any state in India. In this case, the non-resident taxable person shall obtain an obligatory GST registration. The GST registration shall be obtained at least 5 days before creating any supply to India. Also, the GST registration is extended only after an advance deposit of the tax liability at the time of registration. GST registration to a Non- Resident can be given based on:

  • Income Tax PAN
  • Valid Passport in case of an individual
  • TAN (Tax Identification Number) in case of incorporated business entity.

  • PAN Card of the Business:

    GST registration is a 15-digit PAN-based number issued by the GST department

    Proprietorship: PAN Card of the proprietor

    Partnership/LLP: PAN cards of Partnership/LLP & Partners

    Companies: PAN card of COMPANY & Directors

    Body Corporates: PAN card of Body Corporate & authorized signatory

  • Address proof of promoter along with photographs:

    GST registration requires photographs and Aadhar Card of proprietor/partners/directors/authorized signatory.

    In the case of Foreign Nationals, Passport is mandatory

  • Business Registration Proof:

    Registered Partnership Firm/LLP/Companies: The Registration Certificate or Certificate of Incorporation

    Unregistered partnership firms: The notarized partnership deed

    Proprietorship: NIL

  • Business address proof:
