What is GST Return?

Who shall file GST Return?

As per the GST Act, the registered entities have to file 24 returns in a year and one annual return. Entities are required to disclose the monthly sales and purchase in GSTR-3B every month along with GSTR-1 return. Businesses with annual aggregate annual turnover(AATO) exceeding Rs. 5 crores should file monthly GSTR-1 return. Those having annual revenue of less than Rs. 5 crores are required to file GST returns -3B quarterly. Moreover, annual GST returns are mandatory for entities having aggregate annual turnover(AATO) exceeding Rs 2 crore.

Types of GST Returns

GSTR-1

GSTR-1 return is filed monthly or quarterly. It includes the particulars of outward supply of taxable goods and services.

Due Date: Monthly filing: 11th day of every month
Quarterly filing: 13th day of month succeeding the quarter

GSTR-3B

GSTR-3B is a monthly/Quarterly return with the abridgment of an input tax credit, outward supplies, and the tax payment.

Business Aggregate Annual Turnover exceeds Rs 5 Crore Return DUE DATE: 20th of every month.
If the previous financial year's aggregate turnover of the taxpayer exceeds Rs. 5 crores: 20th of the succeeding month.
If equals or less than 5 crores: 22nd of the succeeding month in case of X category states and 24th of the succeeding month in case of Y category states.

CMP-08

CMP-08 is filed quarterly where a taxpayer registered under the composition scheme can file a statement-cum-challan for paying tax.

DUE DATE: 18th of the next quarter.

GSTR-4

GSTR-4 Return is an annual return that fulfils the purpose of a registered taxpayer covered under the composition scheme of CGST(Rate)notification no. 02/2019 and CGST Act (supplier of goods).

DUE DATE: 30th of the month that succeeds a financial year.

GSTR-5

GSTR-5 Return a monthly return filed by a non-resident foreign taxable person.

DUE DATE: 20th of the following month.

GSTR-6

GSTR-6 is filed monthly by an input service distributor eligible input tax credit distribution to its branches.

DUE DATE: 13th of the following month.

GSTR-7

GSTR-7 is a monthly return meant for government authorities to deduct tax at source (TDS).

GSTR-8

GSTR-8 is filed monthly to furnish the particulars of supplies done and tax collected by the e-commerce operators.

DUE DATE: 10th of the following month.

GSTR-9

GSTR-9 is an annual return to be filed by a normal taxpayer.

DUE DATE: 31st of DECEMBER of the following financial year.

GSTR-9A

This is a yearly return filed by the registered taxpayer under the composition.

DUE DATE: 31st of DECEMBER of the following financial year

GSTR-9C

GSTR-9C is an annual reconciliation statement return .

DUE DATE: 31st December of the next financial year.

GSTR-10

GSTR-10 is a Final return filed by a taxpayer on the surrender or cancellation of the GST registration.

DUE DATE: Date of cancellation order or within 3 months of the date of cancellation, whichever is later.

GSTR-11

GSTR-11 is a monthly return where a person with UIN furnishes the details of inward supplies and claims a refund.

DUE DATE: 28th of the month succeeding the month for which the statement has to be filed.

Penalty

If not filed timely, GST returns can put an unnecessary penalty. GST return should be filed within the due date otherwise can impose heavy interests along with a monetary penalty on the taxpayer. The interest charged is usually 18% per annum accompanied by the late fee. The GST Act imposes a late fee of Rs. 25/10 under SGST as well as another Rs. 25/10 under CGST that makes Rs. 50/20 every day of default (not applicable in the case of integrated GST Act). However, the interest paid to the authority in the case of delay can be calculated by a taxpayer based on the outstanding tax penalty.

  • In the case of NIL returns: 20 Rs. per day as a late fee
  • In the case of businesses having turnover:
  • 50 Rs. per day for late filing of GSTR-3B
  • Notification Awaited for late filing of GSTR-1
  • 18% of late GST payment

Composition Scheme Filing

If you are a registered taxpayer and do not want to be bothered by the tedious GST formalities can go for the GST composition scheme. The composition scheme under GST simplifies the complexities that one may face. This scheme helps one to pay GST on turnover at a fixed rate. The scheme is available for the taxpayer having a turnover less than 1.5 crores.

The entities covered under the GST composition scheme should:

  • File CMP-08 Quarterly within the due date i.e. 18 of every quarter ( April 18th, July 18th, October 18th, and January 18th )
  • Furnish the details of inter-state and intra-state purchase whether received from a registered or an unregistered dealer in the return filed.
  • Details of outward supplies in the return filed.

GST composition tax is imposed at the given rates:

  • Any other supplies registered(Traders) under the composition scheme- 1%
  • Service Providers- 6 %.
  • Manufactures or any other manufacturers as apprised by the government-1%
  • Restaurant (Not-serving Alcohol)- 5%

NOTE:Any taxpayer opting for the composition scheme under GST is not entitled to the input tax credit on any invoices or receipts furnished by the supplier for the period before opting for this scheme.

FAQ's

  • Who should file GST returns?
    The person or entity registered under GST would be required to file a GST return on monthly or quarterly basis. Even a person having nil turnover is required to file nil tax return on regular basis.
  • Every taxpayer registered under regular scheme of GST is required to file return GSTR-1 on or before 13th of every month.
  • The types of GST returns a registered person under regular scheme required to file Gstr-1 & Gstr-3b on monthly or quarterly basis. The registered person opting composition scheme required to file GST return CMP-08 on quarterly basis and GSTR-05 on annual basis.
  • The late fee is Rs.50 per day in case of any sales in the business and Rs 20 per day if there is nil GST return.
  • The registered tax payer need to pay interest at 18% per annum for the tax payable.
  • There is no option for revision of a GST Return. It is recommended to get your gst return filed by the tax professional (CA/CS/CWA & Tax Advocates)
